Terms and conditions

SCOPE

These general terms and conditions (“GTC”) apply to all contracts between UniCaps GmbH, Im Technologiepark 6, 15236 Frankfurt/Oder (“UniCaps”), and the buyer (“Customer”) regarding the sale and/or delivery of movable items (“Goods”).

REGISTRATION

Natural persons who are 18 years or older can register as UniCaps customers. years of age, as well as legal entities. Legal entities must be represented by an authorized person who has reached the age of 18 when registering.

The customer must provide the data requested during registration completely and correctly. If the data provided changes after registration, the customer is obliged to correct the information immediately and inform UniCaps.

The personal password chosen by the customer when registering on the Internet must be kept secret and must not be made available to third parties. The customer is responsible for all actions carried out under his password on the Internet pages. www.my-coffee-cup.at (“Website”).

CONCLUSION OF CONTRACT

By clicking the "Buy now" button, the customer places a binding order for the items in the shopping cart. UniCaps will immediately confirm receipt of the order to the customer by email ("confirmation of receipt"). The confirmation of receipt does not constitute a declaration of acceptance on the part of UniCaps.

A contract is only concluded when UniCaps declares acceptance. The declaration of acceptance is sent by a separate email either in the form of an order confirmation or a shipping confirmation no later than five “working days” (Monday to Friday, excluding national public holidays) from receipt of the customer’s order. The customer has 7 days to pay for the order. If payment is not made within 7 days, the order will be cancelled without delivery. If the customer does not receive a declaration of acceptance from UniCaps within five working days of receipt of the confirmation of receipt, the customer's order has not been accepted; a contract is not concluded. Any payments already made by the customer will be refunded immediately, at the latest within ten working days of receipt of payment by UniCaps.


DATA PROTECTION

UniCaps collects customer data as part of the processing of contracts and takes all necessary measures to protect the personal data provided by the customer and to comply with the applicable national and European data protection regulations at all times. UniCaps provides further details at privacy policy or sends them to the customer upon request.

CHOICE OF LAW AND JURISDICTION

If the customer is a merchant, a legal entity under public law or a special fund under public law, Frankfurt/Oder is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same applies if a customer does not have a general place of jurisdiction in Germany, if a customer has moved his or her place of residence or habitual abode abroad after the conclusion of the contract, or if his or her place of residence or habitual abode is unknown at the time the action is brought.

STORAGE OF THE CONTRACT TEXT

The contract text is not saved at UniCaps. It can be printed out during the contract conclusion process. Customers can find individual transactions in the "Account" area.
