SCOPE

These general terms and conditions (“GTC”) apply to all contracts between UniCaps GmbH, Im Technologiepark 6, 15236 Frankfurt/Oder (“UniCaps”), and the buyer /the buyer (“customer”) about the sale and/or delivery of movable items (“goods”).

REGISTRATION

You can register as a customer at UniCaps natural persons who have reached the age of 18 and legal entities. When registering, legal entities must be represented by an authorized representative who has reached the age of 18.

The customer must provide the data requested during registration completely and correctly. If the data provided changes after registration, the customer is obliged to correct the information immediately to UniCaps.

The personal password chosen by the customer when registering on the Internet must be kept secret and must not be made accessible to third parties . The customer is responsible for all actions taken under his password on the websites www.my-coffee-cup.at  (“Internet presence”).

CONCLUSION OF CONTRACT

By clicking the “Buy now” button, the customer places a binding order for the items in the shopping cart. UniCaps will immediately confirm receipt of the order to the customer by email (“confirmation of receipt”). The confirmation of receipt does not constitute a declaration of acceptance by UniCaps.

A contract is only concluded through the declaration of acceptance by UniCaps. The declaration of acceptance is made in a separate email either in the form of an order confirmation or a shipping confirmation no later than five “working days” (Monday – Friday with the exception of national public holidays) from receipt of the customer’s order. The customer has 7 days to pay for the order. If payment is not received within 7 days, the order will be canceled without delivery.  If the customer does not receive a declaration of acceptance from UniCaps within five working days of receipt of the confirmation of receipt, the customer's order has not been accepted; a contract is not concluded.  Any payments already made by the customer will be refunded immediately, at the latest within ten working days of receipt of payment by UniCaps.


DATA PROTECTION

UniCaps collects customer data as part of the processing of contracts and takes all necessary measures to protect the personal data provided by the customer and to comply with applicable national and European data protection regulations at all times. UniCaps has further details available at Data protection declaration or will send it to the customer upon request.

CHOICE OF LAW AND JURISDICTION

Is the customer a businessman, legal Person under public law or special fund under public law, Frankfurt/Oder is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The same applies if a customer does not have a general place of jurisdiction in Germany, a customer has moved his or her place of residence or habitual residence abroad after conclusion of the contract, or if his or her residence or habitual abode is unknown at the time the action is filed.

STORAGE OF THE CONTRACT TEXT

The contract text is not stored at UniCaps. It can be printed during the conclusion of the contract. The customer can find individual transactions in the “Account” area.

In accordance with Section 36 VSBG, we would like to point out that we are neither willing nor obliged to take part in a dispute resolution procedure before a consumer arbitration board.
